1. Introduction

This is the Data Protection Policy of New Forest Direct Cremations Ltd, adopted in pursuance of the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. The Policy is published on the Company's website and a copy may be printed from there.

The Company's representative responsible for data protection enquiries is Mrs Kirsten Rust. Any correspondence relating to this Policy must be directed by email to info@nfd-cremations.co.uk and must include the enquirer's email address and telephone number if a response is requested.

2. Data We Collect

In the proper conduct of its business, the Company collects personal data which is held both electronically and on paper. This includes information provided by clients when making arrangements for direct cremation services, such as contact details, details of the deceased, and relevant documentation required to fulfil legal obligations.

The Company's computer systems, including back-up facilities, are maintained by a specialist contractor and are kept secure. Paper records are retained in appropriate cabinets within locked offices.

In the unlikely event of a breach of the Company's data security that is likely to result in a risk to the rights and freedoms of individuals, the Company will notify the appropriate authorities and any affected individuals without undue delay.

3. How We Use Your Data

Personal data collected by the Company is used solely for the purpose of arranging and carrying out the direct cremation service requested, and for fulfilling the legal and administrative obligations associated with that service. The Company will not use client data to contact clients or other third parties with marketing communications, unrelated matters, or attempts to sell products not associated with the original contract.

There may, however, remain a proper need to continue contact with a client following the conclusion of a service — for instance, accounting for in-memorial donations, liaison in respect of cremated remains, advice regarding post-service bereavement support, and memorials.

4. Data Sharing & Third Parties

The Company does not share, sell, lend, or otherwise transfer the data it gathers to any third party, except where it is required to do so by law, or where it is necessary to do so in pursuance of a client's instructions.

For example, it is necessary to provide a crematorium with details about the deceased and their family in the arrangement of a cremation. In such circumstances, data is provided with the direct or implied instruction of the Company's client, and only to the extent required to carry out the service.

5. Data Retention

The Company has a number of legal responsibilities that require the retention of data, sometimes indefinitely — for example, the obligation to maintain a Register of Cremations. Data collected in the proper pursuance of the Company's work will therefore be retained as required by law and held securely at all times. It will not be made available to third parties, except as set out in Section 4 above.

Under UK GDPR, you have the right to:

  • Access the personal data we hold about you
  • Rectification of inaccurate or incomplete data
  • Erasure of your data, where there is no legal obligation to retain it
  • Restriction of processing in certain circumstances
  • Object to processing based on legitimate interests
